Things are still in a quagmire in the State Senate, Justice McNamara has adjourned the case until Tuesday at 10:00 AM, just for the record, the third time he has done so. As of now, there is a new position among the 31 democrats (Yes, Sen. Monserrata has rejoined the fold) and it belongs to Sen. John Sampson (Kings County). He is now the "conference leader" and Sen. Smith as the president and majority leader according the the 31 that stand shoulder to shoulder.
